Trusts

A trust is an agreement where one party (GRANTOR) gives assets to another party (TRUSTEE) to hold for the benefit of a third party (BENEFICIARY). Contrary to popular belief, trusts are not just for the ultra wealthy. The truth is that a trust will greatly benefit anyone with more than a nominal amount of assets. Some of the benefits include avoiding court, asset protection, privacy, avoiding estate taxes and control of what becomes or your assets after you die.

Powers of Attorney

Powers of Attorney (POA) are legal documents which allow someone to handle the affairs of another when they are unable to do so. It is an important truth that many people will become incapacitated at some point in their lives. Other instruments, such as wills, only go into effect at the time of death and do not address incapacity. General Durable POAs allow a trusted designee to direct your financial affairs when necessary. Medical POAs, together with a Directive to Physicians and a HIPPA Authorization, allow a family member or friend to make healthcare decisions for you when you cannot do so yourself.

Guardianship Nomination

If something happens to you and your spouse, the authorities will be required to give your children to Child Protective Services and into the care of strangers.
